利用規約（EULA）
本利用規約（以下「本規約」）は、お客様と「Nomigoro」（以下「本アプリ」）の開発者（以下「当方」）との間のエンドユーザーライセンス契約（EULA）です。本アプリをダウンロードまたは使用した時点で、本規約に同意したものとみなされます。本規約はAppleの標準EULA（Licensed Application End User License Agreement）を基礎としており、本規約に定めのない事項についてはAppleの標準EULAが適用されます。
1. ライセンス
当方は、App Store利用規約で認められる範囲において、お客様が所有または管理するApple製デバイス上で本アプリを使用するための、個人的・非独占的・譲渡不能・取消可能なライセンスをお客様に付与します。法令で認められる場合を除き、本アプリの複製、改変、リバースエンジニアリング、再配布、転売はできません。
2. アルコールに関するご注意
本アプリはワインの記録・在庫・飲み頃の管理を目的としたツールであり、飲酒を推奨または助長するものではありません。飲み頃の表示は、ワインの一般的な特性に基づく目安であり、健康上の効果・効能を保証または示唆するものでは一切ありません。飲酒される場合は適量を心がけ、過度の飲酒はお控えください。20歳未満の方の飲酒は法律で禁止されています。本アプリ自体は年齢確認の機能を持ちませんが、20歳未満の方は保護者の指導のもとでご利用ください。
3. OCR（ラベル文字認識）に関する免責
本アプリのラベル文字認識機能は、Appleのオンデバイス技術を用いてラベル写真から銘柄・生産者・ヴィンテージ等の候補を「下書き」として提案するものであり、その正確性・完全性を保証するものではありません。実際に保存される内容は、お客様ご自身が確認・編集した上で確定するものとし、当方は下書きの誤りに起因する損害について責任を負いません。
4. 課金・買い切り購入
- 本アプリは、AppleのApp Storeを通じて、非消耗型の買い切り（1回限り）の課金のみを提供します。サブスクリプション（自動更新）は提供していません。価格は購入前にアプリ内に表示されます。
- 購入完了後、お客様のApple Accountに対して1回のみ請求が行われ、以後の自動更新や追加請求は発生しません。
- 返金について: 決済および返金の手続きはすべてAppleが取り扱います。当方側で返金を行うことはできません。返金のお申し出はAppleのreportaproblem.apple.comから行ってください。
- 復元について: 機種変更やアプリの再インストール後は、アプリ内の「購入を復元」から、購入時と同じApple Accountでサインインして復元できます。
5. プライバシー
本アプリはデータを一切収集しません。詳細はプライバシーポリシーをご覧ください。
6. 保証の否認
本アプリは「現状有姿（AS IS）」かつ「提供可能な状態（AS AVAILABLE）」で提供され、商品性、特定目的への適合性、権利非侵害の黙示的保証を含め、明示・黙示を問わずいかなる保証も行いません。本アプリが中断なくエラーなく動作すること、ラベル文字認識の候補が常に正確であること、および飲み頃の提案が実際のワインの状態と一致することを保証するものではありません。
7. 責任の制限
適用法令が許容する最大限の範囲で、当方は、間接損害、付随的損害、特別損害、結果的損害、懲罰的損害その他本アプリの使用または使用不能から生じる損失について、責任を負いません。当方の責任の総額は、請求に先立つ12か月間にお客様が本アプリに対して支払った金額を上限とします。ただし、消費者契約法その他の強行法規により制限できない責任については、この限りではありません。
8. 本アプリおよび本規約の変更
当方は、本アプリおよび本規約を随時更新することがあります。重要な変更は、本ページに掲載し、制定日（改定日）を更新することでお知らせします。変更後に本アプリの使用を継続した場合、変更に同意したものとみなされます。
9. 準拠法・管轄
本規約は日本法に準拠し、日本法に従って解釈されます。本規約に関する紛争については、消費者保護に関する強行法規の定めがある場合を除き、日本の裁判所を専属的合意管轄裁判所とします。
10. Appleが第三受益者であること
AppleおよびAppleの子会社は本規約の第三受益者であり、本規約を執行する権利を有することにお客様は同意します。Appleは本アプリに関する保守・サポートを提供する義務を負いません。サポートは当方が提供します（下記参照）。

Terms of Use (EULA)
These Terms of Use ("Terms") are an end user license agreement (EULA) between you and the developer of Nomigoro ("Nomigoro," "the app," "we," "us"). By downloading or using the app, you agree to these Terms. These Terms are based on, and incorporate the protections of, Apple's standard Licensed Application End User License Agreement; where these Terms are silent, Apple's standard EULA applies.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use Nomigoro on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse engineer, distribute, or resell the app except as permitted by law.
2. A Note About Alcohol
Nomigoro is a tool for recording and tracking your wine collection's drinking windows — it does not encourage or promote alcohol consumption. Drink-window suggestions are general guidance based on typical characteristics of wine styles and do not claim or imply any health benefit whatsoever. Please drink in moderation and avoid excessive alcohol consumption. Drinking alcohol is prohibited by law for anyone under the age of 20 in Japan. The app itself has no age-verification feature; anyone under that age should only use it under a guardian's supervision.
3. OCR (Label Recognition) Disclaimer
The app's label recognition feature uses Apple's on-device technology to propose a draft name, producer, and vintage from a label photo — it does not guarantee the accuracy or completeness of these suggestions. You are responsible for reviewing and editing this information before it is saved, and we are not liable for any loss arising from an inaccurate draft.
4. Purchases — One-Time, Non-Consumable
- Nomigoro offers a single non-consumable, one-time purchase through Apple's App Store. There is no subscription and no auto-renewal. The price is shown in the app before purchase.
- Your Apple Account is charged exactly once at the time of purchase; no further charges or renewals will occur.
- Refunds: All billing and refunds are handled by Apple. We are unable to issue refunds ourselves. Refund requests are made to Apple at reportaproblem.apple.com.
- Restoring your purchase: After a new device or reinstall, use "Restore Purchases" inside the app while signed in to the same Apple Account used for the original purchase.
5. Privacy
Nomigoro collects no data. See the Privacy Policy.
6. Disclaimer of Warranties
The app is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted or error-free, that label-recognition drafts will always be accurate, or that drinking-window suggestions will match the actual condition of any wine.
7. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any losses arising from use of or inability to use the app. Our total liability shall not exceed the amount you paid for the app in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including under the Japanese Consumer Contract Act.
8. Changes to the App or Terms
We may update the app and these Terms from time to time. Material changes will be reflected on this page with an updated effective date. Continued use of the app after changes take effect constitutes acceptance.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of Japan, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Japan, except where mandatory consumer-protection law provides otherwise.
10. Apple as Third-Party Beneficiary
You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them. Apple has no obligation to furnish any maintenance or support services with respect to the app; support is provided by us (see below).
